A-Z Chore Terms of Use

Welcome to azchore.ca ("A-Z Chore") and thank you for visiting. These Terms of Use, along with our Privacy Policy, Mobile Devices Terms, and all other policies posted on our site, define the terms governing your access to and use of our website, services, applications, and tools (collectively referred to as "Services"). The Privacy Policy, Mobile Devices Terms, and all other policies are considered part of these Terms of Use. By accessing or using our Services, you agree to abide by these terms and policies.

A-Z Chore is provided to you by A-Z Chore Inc., 185 Carlton, Unit 200, Winnipeg, Manitoba, Canada R3C 3J1.

Your Account

To use specific features of the Services, you may need to register an account by providing certain details. This could include your email address (a security code will be sent to your inbox for each login), a Google email address with authentication via Google sign-in, or a phone number (a security code will be sent via SMS to your device). The registration process occurs the first time you log in to the A-Z Chore website or mobile apps. The email address or phone number you provide during registration will act as your account identifier, and you are entirely responsible for ensuring the security of your own email account and device. You are accountable for all activities conducted through your Account. Furthermore, transferring your Account to another individual is prohibited without our prior approval.

Your account can function as either a homeowner or a handyman. Homeowners can post tasks (referred to as “Jobs”) on A-Z Chore to connect with handymen who can complete the work. Handymen, on the other hand, offer their services to homeowners by taking on and completing their tasks.

You can connect to the Services using a third-party service, granting us permission to access, store, and use information from that service as allowed by its terms and outlined in our Privacy Policy. If you suspect that your Account has been compromised or misused, please contact us immediately at support@azchore.ca..

Using the Services

When posting your jobs (for homeowners) or services (for handymen) (collectively referred to as "ads") and using our chat system for communication between homeowners and handymen, you agree to refrain from engaging in the following prohibited activities, as outlined here:

Violating any laws;
Being involved in politics, religion, racism, or criminal activities;
Posting content related to pornography, nude photos, videos, articles, or erotic products;
Posting services related to prostitution, escort, or accompanying services;
Posting content that is false or misleading;
Infringing on the rights of any third-party;
Distributing or including spam, chain letters, or pyramid schemes;
Sharing viruses or other technologies that could harm A-Z Chore or its users' interests or property;
Overloading our infrastructure or disrupting the proper functioning of A-Z Chore;
Copying, modifying, or distributing content belonging to others;
Using automated tools like robots, spiders, or scrapers to access A-Z Chore or collect content without explicit written permission;
Gathering information about others, such as email addresses, without their consent;
Circumventing any measures implemented to prevent or restrict access to A-Z Chore.

Misuse of A-Z Chore Services

If you encounter any issues or offensive content, please contact us immediately at support@azchore.ca to help us maintain the proper functioning of A-Z Chore platform. We reserve the right to restrict or terminate access, remove hosted content, and implement technical or legal measures to address users who cause disruptions or violate the intent of our policies. However, regardless of whether we take these actions, remove content, or block users, we are not liable for monitoring the platform or for any unauthorized or unlawful content or activity by users.

Content

The Services include material from us, you, other users, and our third-party service providers. By using the Services, you agree not to copy, alter, resell, or distribute any part of the Services, including our copyrights and trademarks. When you provide content to us, you grant us a non-exclusive, global, permanent, irrevocable, royalty-free, and sublicensable right to use the copyright, publicity, and database rights associated with that content. If you believe your rights have been infringed, please contact us at support@azchore.ca, and we will investigate. We reserve the right to remove any content if we have reason to suspect it violates these terms or infringes on the rights of others.

Fees and Services

Using the Services is typically free, but certain Services may require a fee. If the service you are using has a fee, you will be informed and will have the opportunity to review and accept the charge. Our fees are listed in Canadian Dollars and may be updated periodically. Any changes to our fee policy will be communicated by posting them on the site. We may also adjust our fees temporarily for promotional offers or new services, with such changes taking effect when the promotion or service is announced. All fees are non-refundable, and it is your responsibility to pay them on time. Failure to do so may result in limitations in your use of the Services. If your payment method fails or your account becomes overdue, we may use other methods to collect outstanding fees.

Canadian taxes associated with our Services will be applied when relevant. You agree to provide accurate address details required for A-Z Chore to meet its legal obligations. If this information is not provided, A-Z Chore will decide and collect any applicable taxes as necessary.

Handymen are solely responsible for collecting and remitting any applicable taxes from the sale of services to homeowners.

Although many features are accessible through the A-Z Chore websites and mobile apps, some features may differ depending on which website or mobile device you are using to access the Services.

Disclaimers and Limitations of Liability

The Services are offered on an "as is" and "as available" basis. You agree not to hold us accountable for the actions or posts of other users. Since the majority of content on the Services is provided by users (Homeowners and Handymen), we make no guarantees regarding the accuracy, completeness, reliability, or timeliness of user posts or communications, nor the quality, safety, or legality of the services or items being offered. You also agree not to hold us liable for the payment processing handled by third-party service providers like Stripe (each referred to as a "Third-Party Payment Processor"). To clarify, if you connect a Third-Party Payment Processor account to your A-Z Chore Account, you acknowledge and agree that by making payments through A-Z Chore using that Third-Party Payment Processor, you are bound by their applicable terms and conditions. We are not liable for any losses, claims, or damages that may arise in connection with the services provided by that third-party. We also cannot guarantee continuous or secure access to our Services. Notification functionality in our Services may not occur in real time. Such functionality is subject to delays beyond our control, including without limitation, delays or latency due to your physical location or your wireless data service provider’s network. Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of A-Z Chore, even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.

However, notwithstanding the previous paragraph, if we are deemed liable, our liability to you or any third-party (whether in contract, tort, negligence, strict liability in tort, by statute or otherwise)will be limited to the greater of (a) the total fees you have paid to us in the 12 months before the event that led to the liability, or (b) 100 Canadian Dollars.

Indemnification

You will indemnify and protect A-Z Chore and its affiliates and our and their respective officers, directors, agents and employees collectively referred to as the “Indemnified Parties”), from any claim made by any third-party, together with any amounts payable to the third-party whether in settlement or as may otherwise be awarded, and reasonable legal costs incurred by any of the Indemnified Parties, arising from or relating to your use of the Services, any alleged violation by you of the applicable terms, and any alleged violation by you of any applicable law or regulation. We reserve the right to take over the defense and management of any issue that requires indemnification from you, at our own expense, but this does not relieve you from your indemnification obligations.

Personal Information

By using the Services, you consent to A-Z Chore Inc. (the "data controller") collecting, transferring, storing, and utilizing your personal information on servers located in the United States, as outlined in our Privacy Policy.

Reviews

As a handyman or homeowner, you may be asked to leave a review for a handyman who has worked for you if you are a homeowner, or vice versa, on A-Z Chore. Reviews include a 1-5-star rating along with selected reasons for your evaluation. The review you submit, along with your username, profile photo (if provided), will be publicly visible. Reviews should be submitted in good faith, ensuring that both parties fairly represent their interaction. When leaving a review for another user, it must:

Accurately reflect the interaction between you and the other user.
Not be used to harass or abuse the other user.
Not be intended to mislead or manipulate other users.

To maintain the credibility of the review system, users cannot edit or delete reviews on their profile or others’. Additionally, A-Z Chore will not intervene in disputes related to reviews. Reviews represent the individual opinions of A-Z Chore users and do not reflect the opinion of A-Z Chore.

We reserve the right to remove reviews that breach our policies or guidelines.

Age Restrictions

A-Z Chore prioritizes the safety of your family and aims to reduce risks for all users. As a result, if you are under 16 years old, we ask that a parent or guardian handle any responses to ads you are interested in. Additionally, if you wish to post an ad on A-Z Chore, please have your parent or guardian do so on your behalf, allowing them to be actively involved in the transaction. A-Z Chore also reserves the right to remove any ad if we believe it is necessary to protect the safety and well-being of our users.

General

These terms and the other policies available on the Services constitute the complete agreement between us and you, superseding any previous agreements. This agreement is governed by the laws of the Province of Manitoba and the applicable federal laws of Canada. Both parties agree to submit to the jurisdiction of the courts in Manitoba.

Your statutory rights as a consumer will not be affected, especially when consumer law requires another law to apply in certain cases. If we do not enforce a particular provision, it does not mean we are waiving our right to enforce it later. If a court invalidates any part of this agreement, the rest will remain in effect. We may assign this agreement to others at our discretion, as per the notice section below (assignments to affiliates do not require notice). Re: User Inquiries

We will send notices to you via the email address you provide or by registered mail. Notices sent by registered mail will be considered received five days after the date of mailing. We may update this agreement at any time, with updates taking effect when you next use the site or 30 days later, whichever comes first. No changes to this agreement will be valid unless in writing and signed by both users and us. For inquiries, comments, or complaints, contact us at support@azchore.ca.

Mobile Devices Terms

If you are using the A-Z Chore mobile application (the "Application") on a mobile device to access the Services, the following terms and conditions ("Mobile Device Terms") apply to you, along with the applicable Mobile Privacy and Legal Notice or End User License Agreement, depending on the case. By using the Application, you agree to these Mobile Device Terms.

Application Use

A-Z Chore gives you the right to use the Application under the following restrictions: you may not (a) modify, copy, publish, license, sell, or otherwise commercialize this Application or any information or software associated with this Application; (b) rent, lease or otherwise transfer rights to this Application; or (c) use this Application in any manner that could impair the Application or interfere with any party's use or enjoyment of the Application. You must comply with all applicable laws and third-party terms of agreement when using the Application (e.g. your wireless data service agreement). The Application may not contain the same functionality available on the A-Z Chore website (and certain functionality may not be available depending on which Application and/or mobile device you are using). You are downloading and using the Application at your own risk, and you are fully responsible for any damage to your devices or data loss caused by downloading or using the Application.

Intellectual Property – Applications

A-Z Chore either owns or holds a license for all rights, titles, and interests related to its Applications. This includes rights protected by patents, copyrights, trade secrets, trademarks, and any other proprietary rights, along with their applications, renewals, extensions, and restorations. You are prohibited from modifying, adapting, translating, creating derivative works from, decompiling, reverse-engineering, or disassembling any Application, as well as attempting to extract its source code. Additionally, you must not remove, hide, or alter any copyright notices, trademarks, or other proprietary rights acknowledgments that are attached to, included within, or accessed through any Application.

Policy on Restricted Countries and Foreign Trade Regulations – Applications

The Application, along with its underlying technology, must not be downloaded, exported, or re-exported:

to any country (or to a resident or citizen of such a country) under a U.S. embargo
to individuals listed on the U.S. Department of the Treasury’s Specially Designated Nationals list or the U.S. Department of Commerce’s Denied Party or Entity List; or
to any country, individual, end-user, or entity restricted by U.S. export laws.

When using the Application, you are responsible for adhering to all applicable trade regulations and laws, both domestic and international. This includes ensuring that you are not located in a country subject to a U.S. government embargo, not designated by the U.S. government as a "terrorist-supporting" nation, and not listed on any U.S. government list of restricted or prohibited entities.

Additional Terms

These additional terms and conditions apply based on the type of mobile device where the Application is installed:

iOS – Apple

This agreement is between you and us, not Apple. Apple is not liable for the Application or its content.
You are granted permission to use the Application only on an iOS device that you own or control and as allowed by the Usage Rules outlined in Apple’s current App Store Media Services Terms and Conditions.
Apple is not required to provide maintenance or support for the Application.
Apple holds no responsibility for investigating, defending, settling, or resolving claims of intellectual property infringement made by third-parties.
Apple will not handle any claims from you or third-parties regarding the Application or your ownership or use of it. This includes, but is not limited to
1. claims related to product liability,
2. claims that the Application does not meet legal or regulatory requirements, and
3. claims under consumer protection or similar laws.
If the Application fails to meet any applicable warranty, you can notify Apple. They may refund the purchase price, if applicable. Beyond this, Apple has no further warranty obligations regarding the Application, as permitted by law.
Apple and its subsidiaries are third-party beneficiaries of these terms. By accepting the terms, you acknowledge Apple’s right to enforce them against you as a third-party beneficiary.

Android - Google

These terms are an agreement between you and us, and not with Google. Google holds no responsibility for the Application or its content.
Your use of the Application must comply with Google’s then-current Google Play Store Terms of Service;
Google serves only as the provider of the Google Play Store, where the Application was downloaded;
Google has no obligation or liability to you with respect to the Application or these terms; and
By accepting these terms, you acknowledge and agree that Google is a third-party beneficiary with rights related to this agreement and the Application.

Mobile Privacy and Legal Notice

This Mobile Privacy and Legal Notice outlines your privacy rights concerning our collection, use, sharing, and protection of your personal information. It applies to any A-Z Chore Mobile Application Service (App) that references this notice. By installing and using this app, you expressly acknowledge and consent to our collection, use, and sharing of your personal information as outlined below and as fully described in our user Privacy Policy, and you agree to abide by our Terms of Use above. We reserve the right to update our user Privacy Policy and Terms of Use periodically, in alignment with the Privacy Policy and Terms of Use above

To maximize the benefits of this App, please opt-in or adjust your collection settings through your phone's privacy settings (if applicable). Collection, Use, Sharing, and Protection of Your Personal Information

Collection

With your permission, we may access your mobile device's precise location data to offer you a personalized experience.
With your consent, we may access the camera or photo library on your mobile device, allowing you to perform actions like listing an ads.

Use

With your permission, we may use your information to display personalized ads. You can opt-out by adjusting your device's settings or, if applicable, by modifying your AdChoices preferences.

Sharing

We will only share your information with third-parties for their marketing purposes if you give us your consent.
We provide your information to service providers we have contracts with, who assist us in running our business and process your data based on our instructions.
We may share your information with law enforcement or authorized parties to investigate criminal activities or breaches of our user agreement.

Protection

We safeguard your information with technical and administrative security measures aimed at minimizing the risks of loss or misuse.
